This Privacy Notice sets out how Kerv and Trakstar Hire use and protect any information that you give Kerv and which is processed through your use of the Trackstar Hire site.

By submitting your application, you are agreeing to Trakstar Hire processing your personal data in relation to your job application.  Trakstar Hire’s privacy policy is here https://mitratech.com/en_gb/privacy-policy/.  Because your data will be processed in the United States of America (U.S.) by Trakstar Hire you need to be aware that under U.S. domestic law there are certain programmes enabling access by U.S. public authorities to personal data transferred from the EU to the USA for national security purposes.  As a result, your personal data is not protected in the same ways as required under EU law, and you may not have actionable rights before the courts against the U.S. authorities in respect of their access to your data.

Data privacy is important to us and Kerv is committed to ensuring that your privacy is protected, and we are transparent with our users about data privacy. Should we ask you to provide information by which you can be identified, then you can be assured that it will only be used in accordance with this privacy statement – we will never sell it to third parties and we will always make sure it’s secure. Kerv may need to change this policy from time to time by updating this page, but we will always let you know.

The prime purpose of collecting your data is to enable us to deliver appropriate, quality services to you. This Privacy Statement explains what personal information we collect from you and how we will use it. Personal information is any information that can be used to identify you or that we can link to you.

What data do we collect?

We only collect information you voluntarily provide to us when you want to enquire about our services, you become a customer of the services we provide, or you contact our support department for assistance. We may collect the following information:

  • personal identifiers, contacts and characteristics (for example, name and contact details)
  • account data e.g. telephone numbers, account number, device ID, IP address, service history and usage data;
  • personal data e.g. name, title, date of birth, address and circuit ID;
  • interaction history and connection data e.g. authentication logs, online alias and service performance data;
  • contact information e.g. email address (when you sign up for the newsletter);
  • social media details e.g. profile ID’s and handles;

  • Service information e.g. speed logs.

What are the legal bases we rely for us to process your personal data?

We generally rely on legitimate interests for processing your personal data (as long as our legitimate interests are not overridden by your data protection interests or other fundamental rights and freedoms). Our legitimate interests include sending you information about Kerv (when you sign up to the newsletter), responding to your queries, analysing the use of our website and using the personal data collected to better understand the needs of our customers.

We may, however, rely on any of the other following legal bases if appropriate:

  • your consent (for example, if we serve non-essential cookies). you are able to remove your consent at any time. You can do this by contacting hello@kerv.com;
  • we have a contractual obligation with you (for example, to provide you a service); or
  • we have a legal obligation.

What is the source of your personal information?

Most of the personal information we process is provided to us directly by you, for example when you sign up to the newsletter to receive information about Kerv or enquire about a vacancy using Trakstar Hire.

We also receive and store certain types of personal information automatically whenever you interact with us online. For example, we use cookies and tracking technologies when your web browser.

Examples of the types of personal data we collect in this way include: IP address, device ID, location data, computer and connection information such as browser type and version, time zone setting, browser plug-in types and versions and operating system.

How do we use the information we gather?

What do we do with your personal information?

Your information is securely stored in an encrypted form to protect against unauthorised access or processing.

We retain your personal data where we have an ongoing legitimate business need to do so, and we only retain your personal data so long as is necessary to fulfil the purpose for which it was originally collected. For example, where you make a submit a query to us online, we will keep the personal data for a period which enables us to handle or respond to any complaints or concerns regarding our response or your query.

We will actively review the personal data we hold and delete it securely, or in some cases anonymise it, when there is no longer a legal, business or consumer need for it to be retained. If this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible.

Your right to object – you have the right to object to the processing of your personal data in certain circumstances.

Your rights in relation to automated decision making and profiling – you are protected from having decisions made in respect of your personal data by automated means in certain circumstances. [Kerv does not carry out any automated individual decision-making]

Your right to complain to a supervisory authority –  If you consider that our processing of your personal information infringes data protection laws, you have a legal right to lodge a complaint with a supervisory authority responsible for data protection. You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
